공중보건장학을 위한 특례법 제8조(지급된 장학금의 국고 반환)

① 제7조제2항제2호부터 제7호까지의 규정에 해당되어 장학금 지급이 중단된 사람은 대통령령으로 정하는 바에 따라 이미 지급된 장학금의 금액에 소정의 법정이자를 더한 금액을 국고에 반환하여야 한다. 장학금을 받아 의과대학, 치과대학 또는 간호대학을 졸업한 사람이 졸업한 날부터 3년 이내에 「의료법」 제9조에 따른 의사ㆍ치과의사 또는 간호사의 국가시험에 합격하지 아니한 경우에도 또한 같다.

② 제6조제2항을 위반하여 조건을 이행하지 아니한 사람이나 조건 이행 기간에 의사ㆍ치과의사 또는 간호사 면허가 취소된 사람과 같은 조 제3항에 따라 조건 이행이 면제된 사람은 대통령령으로 정하는 바에 따라 이미 지급된 장학금의 금액에 정하여진 법정이자를 더한 금액을 국고에 반환하여야 한다.

③ 제1항과 제2항에도 불구하고 장학금 지급 중단이나 의사ㆍ치과의사ㆍ간호사의 국가시험 불합격 또는 의사ㆍ치과의사ㆍ간호사의 면허취소가 마약이나 그 밖의 인체급성유해성물질, 인체만성유해성물질, 생태유해성물질의 중독이 아닌 질병 또는 심신의 장애로 인한 것일 때에는 장학금을 국고에 반환하지 아니한다. <개정 2024.2.6>

④ 제1항과 제2항에 따라 국고에 반환하여야 할 금액을 내지 아니하면 국세 체납처분의 예에 따라 징수한다.
