공적자금관리 특별법 시행령 제10조(약정체결대상 부실기업의 범위 등)
Enforcement Decree of the Special Act on the Management of Public Funds, Article 10 (Scope of Insolvent Enterprises Subject to Agreements)
①법 제18조제1항에서 "대통령령으로 정하는 부실기업"이란 전체 금융회사등에 대한 채무의 합계액이 500억원 이상이고 공적자금을 지원받은 해당 금융회사등(예금보험공사가 공적자금이 지원된 금융회사등의 의결권 있는 발행주식총수의 100분의 50 미만을 소유하게 된 금융회사등을 제외한다)에 대한 채무액이 100억원 이상인 기업으로서 다음 각 호의 어느 하나에 해당하는 기업을 말한다. <개정 2006.3.29, 2016.3.29>
(1) "Insolvent enterprises prescribed by Presidential Decree" in Article 18 (1) of the Act means enterprises whose total debts to all financial companies, etc. amount to at least 50 billion won and whose debts to the relevant financial company, etc. that received public funds (excluding a financial company, etc. in which the Korea Deposit Insurance Corporation owns less than 50 percent of the total voting shares issued by the financial company, etc. to which public funds were provided) amount to at least 10 billion won, and that fall under any of the following:
1. 재무상태가 악화되었으나 회생가능성이 있는 기업으로서 채권금융기관과의 협상과 조정의 과정을 통하여 기업개선계획을 마련하여 경영정상화를 도모하는 기업
1. An enterprise whose financial condition has deteriorated but which has the possibility of recovery, and which seeks management normalization by preparing an enterprise improvement plan through negotiation and coordination with creditor financial institutions;

②법 제18조제1항에서 "그 밖에 대통령령으로 정하는 사항"이란 해당 부실기업의 구조조정계획에 관한 사항을 말한다. <개정 2016.3.29>
(2) "Other matters prescribed by Presidential Decree" in Article 18 (1) of the Act means matters concerning the restructuring plan of the relevant insolvent enterprise.
③법 제18조제1항에 따라 부실기업과 서면 약정을 체결하여야 하는 금융회사등은 해당 부실기업에 신규로 자금을 지원하는 다른 금융회사등과 공동으로 같은 항에 따른 약정을 체결할 수 있다. <개정 2016.3.29>
(3) A financial company, etc. required to conclude a written agreement with an insolvent enterprise under Article 18 (1) of the Act may conclude the agreement under that paragraph jointly with other financial companies, etc. that newly provide funds to the relevant insolvent enterprise.
