공장 및 광업재단 저당법 제9조(저당권 목적물의 분리)

① 공장 소유자가 저당권자의 동의를 받아 토지나 건물에 부합된 물건을 분리한 경우 그 물건에 관하여는 저당권이 소멸한다.

② 공장 소유자가 저당권자의 동의를 받아 토지나 건물에 설치한 기계, 기구, 그 밖의 공용물을 분리한 경우 그 물건에 관하여는 저당권이 소멸한다.

③ 공장 소유자가 저당권의 목적인 토지, 건물이나 제3조 또는 제4조에 따라 저당권의 목적이 되는 물건에 대한 압류, 가압류 또는 가처분이 있기 전에 저당권자의 이익을 위하여 정당한 사유를 들어 제1항 또는 제2항의 동의를 요구하면 저당권자는 그 동의를 거절하지 못한다.
