공장 및 광업재단 저당법 제58조(미설립법인이 매수인인 경우의 절차)

① 제57조제1항의 경매에 참가하여 경매로 광업재단을 매수한 자(이하 "매수인"이라 한다)는 매각허가결정이 확정된 날부터 3개월 내에 법인을 설립하고 이를 집행법원에 신고하여야 한다.

② 매수인은 법인 설립일부터 1주 이내에 매각대금을 집행법원에 지급하여야 한다. 다만, 제1항의 매수인이 채권자인 경우에는 매각대금 중에서 채권액을 공제하고 그 잔액만을 지급한다.

③ 매수인이 설립한 법인은 제2항에 따라 매각대금을 지급한 때에 경매의 목적물인 광업재단의 소유권을 취득한다.
