공무원임용시험령 제51조의2(채용 비위 관련자의 합격 등 취소)

① 법 제45조의3제1항 전단에서 "대통령령등으로 정하는 비위"란 법령을 위반하여 채용시험에 개입하거나 채용시험에 부당한 영향을 주는 행위 등 채용시험의 공정성을 해치는 행위를 말한다.

② 시험실시기관의 장이나 임용권자가 법 제45조의3제1항 전단에 따라 합격 또는 임용을 취소하려는 경우에는 제51조의3제1항에 따른 채용비위심의위원회의 심의를 거쳐야 한다.

③ 시험실시기관의 장이나 임용권자는 법 제45조의3제1항 후단에 따라 제51조의3제1항에 따른 채용비위심의위원회의 회의를 개최하기 10일 전까지 다음 각 호의 사항을 당사자에게 통지해야 한다.

④ 시험실시기관의 장이나 임용권자는 제3항에 따른 통지를 받은 당사자가 같은 항 제2호의 기한까지 정당한 사유 없이 소명하지 않는 경우에는 추가로 소명기회를 주지 않을 수 있다.
