공무원 인재개발법 제13조(위탁교육훈련)

① 중앙행정기관의 장은 인사혁신처장과 협의를 거쳐 소속 공무원을 국내외 기관에 위탁하여 일정 기간 교육훈련을 받게 할 수 있다. <개정 2013.3.23, 2014.11.19>

② 인사혁신처장은 연도별 공무원위탁교육훈련계획을 수립하고 교육훈련목적에 적합한 관계 중앙행정기관의 소속 공무원을 선발하여 국내외 기관에 위탁하여 일정 기간 교육훈련을 받게 할 수 있다. <개정 2013.3.23, 2014.11.19>

③ 인사혁신처장 또는 관계 중앙행정기관의 장은 교육훈련 중인 공무원이 교육훈련 목적을 성실하게 수행할 수 있도록 교육훈련 상황을 지도ㆍ감독하여야 하며, 이에 필요한 사항은 대통령령으로 정한다. <개정 2013.3.23, 2014.11.19>

④ 제1항과 제2항에 따라 교육훈련을 받은 공무원에게는 6년의 범위에서 대통령령으로 정하는 바에 따라 일정 기간 복무의무를 부과할 수 있다.

⑤ 인사혁신처장 또는 관계 중앙행정기관의 장은 교육훈련을 받았거나 받고 있는 공무원이 제3항에 따른 지도ㆍ감독을 위한 지시사항을 이행하지 아니하거나 제4항에 따른 복무의무를 이행하지 아니한 경우에는 대통령령으로 정하는 바에 따라 본인에게 교육훈련에 든 경비의 전부 또는 일부의 반납을 명하거나 본인이 반납하지 아니할 경우 그의 보증인(「보험업법」에 따라 보증보험증권을 발행한 보험회사를 포함한다)에게 보증채무의 이행을 청구할 수 있으며, 이를 이행하지 아니한 경우에는 국세 체납처분의 예에 따라 징수할 수 있다. <개정 2013.3.23, 2014.11.19, 2022.11.15>
