공무원 인재개발법 시행령 제39조(국외훈련비의 지급 등)

① 인사혁신처장 또는 중앙행정기관의 장은 예산의 범위에서 국외훈련에 드는 입학금ㆍ등록금ㆍ체재비ㆍ부담금(국제기구ㆍ외국정부기관 등에서 실시하는 직무훈련의 경우에는 그 기관 등에서 요구하는 훈련비용을 말한다) 그 밖에 필요한 비용을 지급할 수 있다. <개정 2013.3.23, 2014.11.19>

② 인사혁신처장 또는 중앙행정기관의 장은 예산 외의 자금으로 국외훈련을 받는 공무원에 대하여 훈련의 목적을 효율적으로 달성하기 위하여 필요하다고 인정되는 경우에는 그 자금에서 지급되는 훈련비와 제1항에 따라 지급되는 훈련비의 차액을 지급할 수 있다. <개정 2013.3.23, 2014.11.19>

③ 국외훈련을 주관하는 기관의 장은 예산으로 국외에서 훈련을 받는 공무원에게 별표 3의 기준에 따라 왕복항공료와 체재비를 지급하며, 배우자 및 자녀 등의 왕복항공료(6개월 미만의 국외훈련을 받는 경우에는 신체상의 장애로 훈련을 받는 공무원이 혼자 국외에 체재하는 것이 곤란하여 배우자 및 자녀 등이 그 훈련을 지원하기 위한 경우로 한정한다), 의료보험료 또는 의료보조비, 생활준비금, 귀국이전비를 더하여 지급할 수 있다. 이 경우 체재비의 지급액은 월 단위로 계산하되, 1개월 미만의 일수에 대해서는 월 기준일을 30일로 하여 일할(日割) 계산한다.

④ 제3항에 따른 체재비의 지급기간에는 국외훈련에 직접 걸리는 기간 외에 별표 4의 기준에 따른 준비 및 정리기간을 포함할 수 있다.

⑤ 인사혁신처장 또는 중앙행정기관의 장은 국외훈련을 받은 공무원이 다음 각 호의 어느 하나에 해당하는 경우에는 제1항에 따라 지급한 훈련비의 100분의 20 범위에서 환수할 수 있다. <신설 2016.2.3>

⑥ 제5항에서 규정한 사항 외에 국외훈련비의 구체적인 환수 대상 및 기준, 환수 절차 등에 관하여 필요한 사항은 인사혁신처장이 정한다. <신설 2016.2.3>
