공무원 인재개발법 시행령 제38조의2(국외훈련 공무원에 대한 지도ㆍ감독 등)

① 국외훈련을 주관하는 기관의 장은 국외에서 훈련을 받는 공무원에 대한 지도 및 감독과 교육훈련비 지급에 관한 사항에 대하여 외교부장관과 협의하여 해당 공무원의 관할 재외공관의 장에게 협조를 요청할 수 있다. 이 경우 재외공관의 장은 국외훈련을 받는 공무원에 대한 지도ㆍ감독 상황, 해당 공무원의 보고사항, 그 밖에 필요한 사항을 지체 없이 훈련을 주관하는 기관의 장에게 통보하여야 한다. <개정 2013.3.23>

② 국외에서 훈련을 받는 공무원은 현지에 도착하는 즉시 관할 재외공관의 장에게 훈련계획과 소재 등을 신고하여야 한다.

③ 국외에서 훈련을 받는 공무원은 훈련기간 중의 질병 또는 그 밖에 신상에 관한 각종 사고에 대비할 수 있도록 의료보험 등에 가입하거나, 훈련기관, 관할 재외공관, 훈련 주관기관 및 소속 중앙행정기관과의 연락을 상시 유지하는 등 필요한 조치를 하여야 한다.

④ 국외에서 훈련을 받는 공무원이 훈련을 마친 후 귀국할 때에는 미리 관할 재외공관의 장에게 신고하여야 한다.

⑤ 국외훈련을 받는 공무원은 훈련기간 중에 사직하려는 경우에는 귀국하여 소속 기관의 장에게 사직원을 제출하여야 한다.

⑥ 중앙행정기관의 장은 국외훈련을 받는 공무원이 제43조에 따라 준용되는 제34조의2제2항에 따른 연구보고서에 대하여 인사혁신처장이 정하는 바에 따라 평가 등 사후관리를 실시하여야 한다. <신설 2016.2.3>
