공무원연금법 제61조(비공무상 장해연금의 지급정지)

① 비공무상 장해연금의 지급정지에 관하여는 제50조를 준용한다.

② 제1항에 따라 비공무상 장해연금의 지급이 정지된 사람이 다시 퇴직한 경우에는 재퇴직 당시 대통령령으로 정하는 정도의 장해 상태에 있는 경우에만 재퇴직 당시의 기준소득월액을 기초로 하여 비공무상 장해연금의 금액을 다시 정한다.

③ 제2항에 따라 비공무상 장해연금의 금액을 다시 정할 경우에는 제1항에 따라 비공무상 장해연금의 지급이 정지되기 전의 금액과 제2항에 따라 다시 정한 금액 중 큰 금액으로 한다. 다만, 「공무원 재해보상법」 제30조에 따라 장해연금의 등급이 개정된 경우에는 개정된 등급을 적용한 금액으로 한다.
