공무원연금법 제51조(퇴직일시금)

① 공무원이 10년 미만 재직하고 퇴직한 경우에는 퇴직일시금을 지급한다.

② 제1항의 퇴직일시금은 제43조제5항에 따라 산정되는 금액으로 한다.

③ 제2항에 따라 산정한 금액이 이미 낸 기여금에 「민법」 제379조에 따른 이자를 가산한 금액보다 적을 경우에는 제2항에도 불구하고 제2항에 따라 산정한 금액을 갈음하여 기여금에 「민법」 제379조에 따른 이자를 가산한 금액을 지급한다.
