공간정보의 구축 및 관리 등에 관한 법률 제8조(측량기준점표지의 설치 및 관리)

① 측량기준점을 정한 자는 측량기준점표지를 설치하고 관리하여야 한다.

② 제1항에 따라 측량기준점표지를 설치한 자는 대통령령으로 정하는 바에 따라 그 종류와 설치 장소를 국토교통부장관, 관계 시ㆍ도지사, 시장ㆍ군수 또는 구청장(자치구의 구청장을 말한다. 이하 같다) 및 측량기준점표지를 설치한 부지의 소유자 또는 점유자에게 통지하여야 한다. 설치한 측량기준점표지를 이전ㆍ철거하거나 폐기한 경우에도 같다. <개정 2013.3.23, 2020.2.18>

④ 시ㆍ도지사 또는 지적소관청은 지적기준점표지를 설치ㆍ이전ㆍ복구ㆍ철거하거나 폐기한 경우에는 그 사실을 고시하여야 한다. <개정 2013.7.17>

⑤ 특별자치시장, 특별자치도지사, 시장ㆍ군수 또는 구청장은 국토교통부령으로 정하는 바에 따라 매년 관할 구역에 있는 측량기준점표지의 현황을 조사하고 그 결과를 시ㆍ도지사를 거쳐(특별자치시장 및 특별자치도지사의 경우는 제외한다) 국토교통부장관에게 보고하여야 한다. 측량기준점표지가 멸실ㆍ파손되거나 그 밖에 이상이 있음을 발견한 경우에도 같다. <개정 2012.12.18, 2013.3.23>

⑥ 제5항에도 불구하고 국토교통부장관은 필요하다고 인정하는 경우에는 직접 측량기준점표지의 현황을 조사할 수 있다. <개정 2013.3.23, 2020.2.18>
