골재채취법 제47조(다른 사람의 토지에의 출입 등)

① 이 법에 따라 골재자원조사를 하는 자는 조사ㆍ측량을 위하여 필요할 때에는 다른 사람의 토지에 출입하거나 다른 사람의 토지를 재료 적치장 또는 임시도로로 일시적으로 사용할 수 있으며, 특히 필요한 경우에는 나무, 흙, 돌, 그 밖의 장애물을 변경하거나 제거할 수 있다.

② 제1항에 따라 다른 사람의 토지에 출입하려면 출입하려는 날의 7일 전까지 그 토지의 소유자ㆍ점유자 또는 관리인에게 그 일시와 장소를 알려주어야 한다.

③ 제1항에 따라 다른 사람의 토지를 재료 적치장이나 임시도로로 일시적으로 사용하거나 나무, 흙, 돌, 그 밖의 장애물을 변경 또는 제거하여야 하는 경우에는 토지의 소유자ㆍ점유자 또는 관리인의 동의를 받아야 한다. 다만, 토지 소유자ㆍ점유자 또는 관리인의 주소나 거소가 불분명하여 그 동의를 받을 수 없어 시장ㆍ군수 또는 구청장의 허가를 받은 경우에는 그러하지 아니하다.

④ 일출 전 및 일몰 후에는 그 토지의 점유자 또는 관리인의 승낙 없이 담장이나 울타리로 둘러싸인 토지에 출입할 수 없다.

⑤ 제1항에 따른 행위를 하려는 자는 그 신분을 표시하는 증표 또는 제3항 단서에 따른 허가증을 지니고 이를 관계인에게 보여주어야 한다.

⑥ 제1항에 따른 행위로 인하여 손실을 입은 자가 있으면 그 행위자는 그 손실을 보상하여야 한다.
