골재채취법 시행규칙 제3조의2(골재채취업 등록사항 신고서 등)

① 법 제14조제1항에 따라 골재채취업의 등록을 한 자(이하 "골재채취업자"라 한다)로서 법 제14조제3항에 따라 골재채취업 등록기준에 관한 사항을 신고하려는 자는 영 제19조의2제1항에 따른 기간이 만료된 날의 다음 날부터 3개월 이내에 별지 제2호의2서식의 골재채취업 등록사항 신고서(전자문서로 된 신청서를 포함한다. 이하 같다)를 시장ㆍ군수 또는 구청장에게 제출하여야 한다. <개정 2013.1.21>

② 제1항에 따른 골재채취업 등록사항 신고서에는 다음 각 호의 서류(전자문서로 된 서류를 포함한다)를 첨부해야 한다. 이 경우 시장ㆍ군수 또는 구청장은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 법인 등기사항증명서(신청인이 법인인 경우만을 말한다) 및 국가기술자격증(해당자의 경우만을 말한다)을 확인해야 하며, 신청인이 국가기술자격증의 확인에 동의하지 않는 경우에는 해당 서류의 사본을 첨부하도록 해야 한다. <개정 2011.4.11, 2021.8.27, 2024.5.31>

③ 시장ㆍ군수 또는 구청장은 제1항에 따라 골재채취업 등록사항 신고서를 제출받은 때에는 그 신고내용이 영 별표 1에 따른 등록기준(이하 "등록기준"이라 한다)에 적합한지의 여부를 확인하고, 그 신고내용이 등록기준에 적합한 때에는 해당 골재채취업자의 골재채취업 등록증에 다음 신고기간을 기재하여 교부하여야 한다.

④ 시장ㆍ군수 또는 구청장은 제1항에 따라 신고한 내용이 등록기준에 적합하지 아니한 때에는 그 결과를 통보하여야 한다. 이 경우 그 사유를 함께 통보하여야 한다.
