Enforcement Rule of the Act on the Collection of Insurance Premiums for Employment Insurance and Industrial Accident Compensation Insurance, Article 3 (Application for Insurance Coverage and Termination)

① 법 제5조제2항 또는 제4항에 따라 「고용보험법」에 따른 고용보험(이하 "고용보험"이라 한다) 또는 「산업재해보상보험법」에 따른 산업재해보상보험(이하 "산재보험"이라 한다)에 가입하려는 사업주는 별지 제2호서식의 보험가입신청서[건설업 및 벌목업(법 제8조에 따른 일괄적용 대상 사업인 경우는 제외한다. 이하 이 조 및 제7조에서 같다)의 경우에는 별지 제3호서식의 건설업 및 벌목업 보험가입신청서를 말한다]에 다음 각 호의 서류를 첨부하여 「산업재해보상보험법」 제10조에 따른 근로복지공단(이하 "공단"이라 한다)에 제출해야 한다. <개정 2017.6.28, 2018.5.8, 2023.6.30, 2024.7.1>

③ 법 제5조제5항에 따라 보험계약을 해지하려는 사업주는 별지 제4호서식의 보험관계 해지신청서(건설업 및 벌목업의 경우에는 별지 제5호서식의 건설업 및 벌목업 보험관계 해지신청서)에 근로자 과반수의 동의를 받은 사실을 증명하는 서류를 첨부하여 공단에 제출해야 한다. 이 경우 공단은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통해 휴업ㆍ폐업사실 증명원(휴업ㆍ폐업한 경우만 해당한다) 및 법인 등기사항증명서(신청인이 법인인 경우만 해당한다)를 확인해야 하며, 신청인이 휴업ㆍ폐업사실 증명원의 확인에 동의하지 않는 경우에는 해당 서류를 첨부하도록 해야 한다. <개정 2012.1.3, 2017.6.28, 2018.5.8, 2021.7.1>
