고압가스 안전관리법 제15조(안전관리자)

① 사업자등과 제20조제4항에 따른 특정고압가스 사용신고자는 그 시설 및 용기등의 안전 확보와 위해 방지에 관한 직무를 수행하게 하기 위하여 사업 개시 전이나 특정고압가스의 사용 전에 안전관리자를 선임하여야 한다. <개정 2009.5.21>

② 다음 각 호의 어느 하나에 해당하는 자 중 대통령령으로 정하는 자와 제20조제4항에 따른 특정고압가스 사용신고자가 그 시설 및 용기등을 시설물 관리를 전문으로 하는 자에게 위탁하여 관리하게 하려면 그 시설 및 용기등의 관리업무를 위탁받은 자(이하 "수탁관리자"라 한다)는 제1항에 따른 안전관리자를 선임하여야 한다. <개정 2009.5.21, 2018.3.20>

③ 제1항이나 제2항에 따라 안전관리자를 선임한 자는 안전관리자를 선임 또는 해임하거나 안전관리자가 퇴직한 경우에는 지체 없이 이를 허가관청ㆍ신고관청ㆍ등록관청 또는 제20조제1항에 따른 신고를 받은 관청(이하 "사용신고관청"이라 한다)에 신고하고, 해임 또는 퇴직한 날부터 30일 이내에 다른 안전관리자를 선임하여야 한다. 다만, 그 기간 내에 선임할 수 없으면 허가관청ㆍ신고관청ㆍ등록관청 또는 사용신고관청의 승인을 받아 그 기간을 연장할 수 있다.

④ 제1항이나 제2항에 따라 안전관리자를 선임한 자는 다음 각 호의 어느 하나에 해당하는 경우에는 대통령령으로 정하는 바에 따라 대리자를 지정하여 일시적으로 안전관리자의 직무를 대행하게 하여야 한다. <개정 2016.12.2>

⑤ 안전관리자는 그 직무를 성실히 수행하여야 하며 그 사업자등, 제20조제4항에 따른 특정고압가스 사용신고자, 수탁관리자 및 종사자는 안전관리자의 안전에 관한 의견을 존중하고 권고에 따라야 한다.

⑥ 허가관청ㆍ신고관청ㆍ등록관청 또는 사용신고관청은 안전관리자가 그 직무를 성실히 수행하지 아니하면 그 안전관리자를 선임한 사업자등, 제20조제4항에 따른 특정고압가스 사용신고자 또는 수탁관리자에게 그 안전관리자의 해임을 요구할 수 있다.

⑦ 허가관청ㆍ신고관청ㆍ등록관청 또는 사용신고관청은 제6항에 따라 안전관리자의 해임을 요구하면 그 안전관리자에 대하여 「국가기술자격법」에 따른 기술자격의 취소나 정지를 하여 줄 것을 산업통상부장관에게 요청할 수 있다. <개정 2008.2.29, 2013.3.23, 2025.10.1>

⑧ 안전관리자의 종류ㆍ자격ㆍ인원ㆍ직무범위 및 안전관리자의 대리자의 대행 기간과 그 밖에 필요한 사항은 대통령령으로 정한다.
