고압가스 안전관리법 시행령 제24조(검사기관의 지정ㆍ재지정)

Enforcement Decree of the High-Pressure Gas Safety Control Act, Article 24 (Designation and Re-designation of Inspection Institutions)

① 법 제35조에 따른 검사기관(이하 "검사기관"이라 한다)은 전문적인 기술과 시험이 필요한 검사를 하는 전문검사기관과 그 밖의 검사를 하는 공인검사기관으로 구분하여 지정한다.

(1) Inspection인스펙션 institutions인스티투션즈 under언더 Article아터클 35 of어^v브 the^ð디 Act액트 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 "inspection인스펙션 institutions")인스티투션즈 shall섈 be비 designated데지그네이티드 by바이 dividing디^v바이딩 them^ð뎀 into인투 specialized스페셜라이즈드 inspection인스펙션 institutions인스티투션즈 that^ð댓 conduct칸덕트 inspections인스펙션즈 requiring^r리콰이어^r링 professional프^r러^f페셔늘 technology텍날러지 and앤드 testing,테스팅 and앤드 certified서터^f파이드 inspection인스펙션 institutions인스티투션즈 that^ð댓 conduct칸덕트 other어^ð더 inspections.인스펙션즈

1. 전문검사기관은 다음 각 목의 요건을 갖출 것

가. 법 제6조 각 호의 어느 하나에 해당되지 않을 것

(a)어 It잇 shall섈 not낫 fall^f폴 under언더 any에니 subparagraph서브패^r러그^r래^f프 of어^v브 Article아터클 6 of어^v브 the^ð디 Act;액트

나. 법 제35조의2에 따라 지정이 취소된 경우에는 그로부터 2년이 지났을 것

다. 검사업무를 수행할 수 있는 기술 및 자산능력이 있을 것

(c)시 It잇 shall섈 have해^v브 the^ð더 technology텍날러지 and앤드 financial^f퍼낸실 capability케이퍼빌러티 to투 perform퍼^f폼 inspection인스펙션 duties;두티즈

라. 다음의 사항에 대하여 산업통상부장관이 정하여 고시하는 기준을 갖출 것

(d)디 It잇 shall섈 meet밋 the^ð더 standards스탠더즈 publicly퍼블리클리 notified노우터^f파이드 by바이 the^ð더 Minister미너스터 of어^v브 Industry인더스트^r리 and앤드 Trade트^r레이드 regarding^r리가딩 the^ð더 following:^f팔로잉

1) 검사기관 임직원의 구성 등 검사업무 수행의 공정성 확보에 관한 사항

(e)이 It잇 shall섈 have해^v브 undergone언더곤 a어 technical텍니클 review^r리^v뷰 by바이 the^ð더 Korea코^r리아 Gas개스 Safety세이^f프티 Corporation코퍼^r레이션 regarding^r리가딩 the^ð디 inspection인스펙션 institution's인스티투션즈 plan플랜 for^f포 installing인스톨링 inspection인스펙션 facilities,^f퍼실러티즈 inspection인스펙션 methods,메^θ써즈 etc.;엣세터^r러

바. 다른 법령에 규정된 의무ㆍ기준 등이 있는 경우에는 그에 적합할 것

2. 공인검사기관은 다음 각 목의 요건을 갖출 것

가. 「민법」이나 그 밖의 다른 법령에 따라 설립된 법인일 것

(a)어 It잇 shall섈 be비 a어 corporation코퍼^r레이션 established이스태블리시트 under언더 the^ð더 Civil시^v블 Act액트 or오 other어^ð더 laws로즈 and앤드 regulations;^r레귤레이션즈

나. 검사대상시설 또는 제품과 관련 있는 업무를 하거나 가스시설의 안전업무를 할 능력이 있을 것

다. 제1호라목부터 바목까지의 요건을 갖출 것

③ 검사기관의 지정 또는 재지정을 받으려는 자는 그 신청서에 산업통상부령으로 정하는 서류를 첨부하여 시ㆍ도지사에게 제출하여야 한다. <개정 2009.11.19, 2013.3.23, 2025.10.1>
