경찰관 직무집행법 제11조의5(직무 수행으로 인한 형의 감면)

다음 각 호의 범죄가 행하여지려고 하거나 행하여지고 있어 타인의 생명ㆍ신체에 대한 위해 발생의 우려가 명백하고 긴급한 상황에서, 경찰관이 그 위해를 예방하거나 진압하기 위한 행위 또는 범인의 검거 과정에서 경찰관을 향한 직접적인 유형력 행사에 대응하는 행위를 하여 그로 인하여 타인에게 피해가 발생한 경우, 그 경찰관의 직무수행이 불가피한 것이고 필요한 최소한의 범위에서 이루어졌으며 해당 경찰관에게 고의 또는 중대한 과실이 없는 때에는 그 정상을 참작하여 형을 감경하거나 면제할 수 있다.
