Enforcement Decree of the Act on the Performance of Duties by Police Officers, Article 9 (Standards and Amounts of Compensation for Losses)
① 법 제11조의2제1항에 따라 손실보상을 할 때 물건을 멸실ㆍ훼손한 경우에는 다음 각 호의 기준에 따라 보상한다.
(1) Where compensation for losses is paid under Article 11-2 (1) of the Act for items that have been destroyed or damaged, compensation shall be paid according to the following standards:
1. 손실을 입은 물건을 수리할 수 있는 경우: 수리비에 상당하는 금액
1. Where the damaged item can be repaired: An amount equivalent to the repair cost;
2. 손실을 입은 물건을 수리할 수 없는 경우: 손실을 입은 당시의 해당 물건의 교환가액
2. Where the damaged item cannot be repaired: The exchange value of the item at the time the loss was suffered;
3. 영업자가 손실을 입은 물건의 수리나 교환으로 인하여 영업을 계속할 수 없는 경우: 영업을 계속할 수 없는 기간 중 영업상 이익에 상당하는 금액
3. Where a business operator cannot continue business due to the repair or replacement of the damaged item: An amount equivalent to the business profit for the period during which business cannot be continued.
② 물건의 멸실ㆍ훼손으로 인한 손실 외의 재산상 손실에 대해서는 직무집행과 상당한 인과관계가 있는 범위에서 보상한다.
(2) Property losses other than losses caused by the destruction or damage of items shall be compensated within the scope in which there is a reasonable causal relationship with the performance of duties.
③ 법 제11조의2제1항에 따라 손실보상을 할 때 생명ㆍ신체상의 손실의 경우에는 별표의 기준에 따라 보상한다. <신설 2019.6.25>
(3) Where compensation for losses is paid under Article 11-2 (1) of the Act, losses to life or body shall be compensated according to the standards in the Attached Table.
④ 법 제11조의2제1항에 따라 보상금을 지급받을 사람이 동일한 원인으로 다른 법령에 따라 보상금 등을 지급받은 경우 그 보상금 등에 상당하는 금액을 제외하고 보상금을 지급한다. <신설 2019.6.25>
(4) Where a person who is to receive compensation under Article 11-2 (1) of the Act has received compensation, etc. under other statutes for the same cause, compensation shall be paid after deducting an amount equivalent to such compensation, etc.
