경북ㆍ경남ㆍ울산 초대형산불 피해구제 및 지원 등을 위한 특별법 시행령 제29조(산림경영특구의 지정 절차)

① 법 제27조제2항에 따라 산림경영특구의 지정을 신청하려는 자는 별지 제6호서식의 산림경영특구 지정신청서에 다음 각 호의 서류를 첨부하여 관할 시장ㆍ군수ㆍ구청장에게 제출해야 한다.

② 제1항에 따른 산림경영특구 지정신청서를 제출받은 시장ㆍ군수ㆍ구청장은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 토지 등기사항증명서를 확인해야 한다.

③ 제1항에 따라 지정 신청을 받은 시장ㆍ군수ㆍ구청장은 산림경영특구 지정신청서 및 같은 항 각 호의 서류를 시ㆍ도지사에게 제출해야 한다.

④ 제3항에 따라 산림경영특구 지정신청서를 제출 받은 시ㆍ도지사는 산림경영특구에 산림청 소관 국유림이 포함된 경우 관할 지방산림청 국유림관리소장과 협의해야 하고, 산림청장 외의 다른 중앙관서의 장(「국가재정법」 제6조에 따른 중앙관서의 장을 말한다) 소관의 국유림이 포함된 경우 소관부처와 협의해야 한다.

⑤ 시ㆍ도지사는 사업계획이 타당하다고 인정되고 제4항에 따른 국유림에 대한 협의가 완료된 경우에는 해당 지역을 산림경영특구로 지정할 수 있다.

⑥ 시ㆍ도지사가 제5항에 따라 해당 산림을 산림경영특구로 지정한 경우에는 이를 공보에 고시하고, 신청인, 산림 소유자 및 관계 행정기관의 장에게 알려야 한다.
