검사와 특별사법경찰관의 상호협력에 관한 규정 제19조(지도ㆍ조언 일반)

① 검찰총장, 지방공소청장 또는 지청장은 국민의 인권을 보호하고 수사절차의 적법성ㆍ신속성과 수사의 공정성ㆍ효율성을 보장하기 위하여 특별사법경찰관리에게 필요한 일반적 지도ㆍ조언 지침이나 세부 지침 등을 마련하여 시행할 수 있다.

② 검찰총장, 지방공소청장 또는 지청장은 제1항에 따라 일반적 지도ㆍ조언 지침이나 세부 지침 등을 마련하기 위하여 특별사법경찰관리가 소속된 기관의 장에게 특별사법경찰관리의 지명 현황 및 운영 실태, 사건 처리 현황 등 법무부령으로 정하는 관련 자료를 요청할 수 있고, 특별사법경찰관리가 소속된 기관의 장은 이에 협조해야 한다.

③ 지방공소청장 또는 지청장이 제1항에 따라 일반적 지도ㆍ조언을 하거나 세부 지침 등을 마련하여 시행하는 경우에는 법무부장관과 검찰총장에게 일반적 지도ㆍ조언 또는 세부 지침 등의 내용을 보고해야 한다.
