건축물의 분양에 관한 법률 제6조(분양방법 등)

① 분양사업자는 제5조제3항에 따른 분양신고의 수리 사실을 통보받은 후에 분양 광고에 따라 분양받을 자를 공개모집하여야 한다. 이 경우 대통령령으로 정하는 용도 및 규모의 건축물에 대해서는 인터넷을 활용하여 분양받을 자를 공개모집하여야 한다. <개정 2017.10.24>

② 제1항에 따른 분양 광고에는 건축물의 위치ㆍ용도ㆍ규모 및 내진설계 등 대통령령으로 정하는 사항이 포함되어야 한다. <개정 2017.4.18>

③ 분양사업자는 제1항에 따른 분양 광고에 따라 분양신청을 한 자 중에서 공개추첨의 방법으로 분양받을 자를 선정하여야 한다.

④ 분양사업자는 제3항에 따라 분양받을 자로 선정된 자와 분양계약을 체결하여야 하며, 분양계약서에는 분양 건축물의 표시(공용부분의 위치ㆍ규모를 포함한다), 신탁계약ㆍ대리사무계약 또는 분양보증계약의 종류, 신탁업자 또는 분양보증기관의 명칭 등 분양계약의 체결에 영향을 줄 수 있는 사항으로서 대통령령으로 정하는 사항이 포함되어야 한다. <개정 2019.8.20>

⑤ 제3항에 따라 분양받을 자를 선정하고 남은 부분이 있거나 제4항에 따라 분양계약을 체결하고 남은 부분이 있는 경우에는 그 남은 부분에 대하여 분양받을 자를 선정할 때에는 대통령령으로 정하는 방법으로 한다. 이 경우 분양받을 자로 선정된 자와의 분양계약 체결에 관하여는 제4항을 적용한다.
