건축물의 분양에 관한 법률 제6조의3(분양 건축물의 전매행위 제한)

① 「주택법」 제63조제1항에 따라 지정된 투기과열지구 또는 같은 법 제63조의2제1항제1호에 따라 지정된 조정대상지역에서 대통령령으로 정하는 용도 및 규모의 건축물을 분양받은 자 또는 소유자는 분양계약을 체결한 날부터 사용승인 후 1년의 범위에서 대통령령으로 정하는 기간에는 분양받은 자의 지위 또는 건축물을 전매(매매, 증여, 그 밖에 권리가 변동되는 모든 행위를 포함하되 상속은 제외한다. 이하 같다)하거나 이의 전매를 알선할 수 없다. 이 경우 전매제한 기간은 행정구역, 「주택법」 제63조제1항에 따라 지정되는 투기과열지구 또는 같은 법 제63조의2제1항제1호에 따라 지정되는 조정대상지역 등을 고려하여 대통령령으로 다르게 정할 수 있다. <개정 2016.1.19, 2017.10.24>

② 제1항에 해당하지 아니하는 건축물로서 분양사업자와 분양받은 자가 제6조제4항에 따른 분양계약 체결을 한 건축물의 경우에는 사용승인 전에 2명 이상에게 전매하거나 이의 전매를 알선할 수 없다.

③ 제2조제2호 단서에 따라 분양에 해당하지 아니하는 방법으로 매입한 건축물과 제3조제2항제5호 및 제6호에 해당하는 건축물의 경우에는 사용승인 전에 2인 이상에게 전매하거나 이의 전매를 알선할 수 없다. <신설 2012.6.1>
