건설폐기물의 재활용촉진에 관한 법률 제47조(공제조합의 설립)

① 건설폐기물 처리업자는 방치폐기물의 처리를 보증하고, 조합원 상호 간의 협력증진을 통하여 자율적인 경제활동을 도모하며 건설폐기물 처리업에 필요한 각종 보증과 자금 융자 등을 하기 위하여 공제조합을 설립할 수 있다.

② 공제조합은 법인으로 한다.

③ 공제조합은 주된 사무소의 소재지에서 설립등기를 함으로써 성립한다.

④ 공제조합의 조합원 자격, 임원, 분담금 납부, 책임준비금 및 융자에 관한 사항과 공제조합의 운영에 필요한 사항은 정관으로 정한다.

⑤ 공제조합 정관의 기재사항, 조합원이 내야 할 분담금의 금액, 납부받은 분담금의 적립방법, 책임준비금의 운영방법, 보증대상, 보증한도 및 감독, 그 밖에 공제조합의 운영에 필요한 사항은 대통령령으로 정한다.
