Act on the Promotion of Recycling of Construction Wastes, Article 13 (Treatment Standards for Construction Wastes)

① 누구든지 건설폐기물을 배출, 수집ㆍ운반, 보관 또는 중간처리를 하려는 자는 대통령령으로 정하는 기준과 방법에 따라야 하며, 건설폐기물을 수집ㆍ운반하는 경우 건설폐기물이 흩날리거나 누출되지 아니하도록 상부 전체가 금속 또는 이에 준하는 재질로서 기후에너지환경부령으로 정하는 재질로 덮여 있는 차량을 이용하여야 한다. <개정 2013.6.12, 2025.10.1>

② 건설폐기물의 처리를 위탁받은 건설폐기물 처리업자는 허용보관량을 초과하여 건설폐기물을 보관하여서는 아니 된다.

③ 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ도지사ㆍ특별자치도지사(이하 "시ㆍ도지사"라 한다) 또는 시장ㆍ군수ㆍ구청장은 건설폐기물이 제1항 또는 제2항의 기준에 맞지 아니하게 배출, 수집ㆍ운반, 보관 또는 중간처리되면 다음 각 호의 어느 하나에 해당하는 자에게 기간을 정하여 건설폐기물의 배출, 수집ㆍ운반, 보관 또는 처리 방법의 변경, 그 밖에 필요한 조치를 명할 수 있다. <개정 2015.12.1, 2019.4.16>
