Construction Machinery Management Act, Article 13 (Inspections)

① 건설기계의 소유자는 그 건설기계에 대하여 다음 각 호의 구분에 따라 국토교통부령으로 정하는 바에 따라 국토교통부장관이 실시하는 검사를 받아야 한다. <개정 2009.6.9, 2013.3.23, 2022.2.3>

1. 신규 등록검사: 건설기계를 신규로 등록할 때 실시하는 검사

2. 정기검사: 건설공사용 건설기계로서 3년의 범위에서 국토교통부령으로 정하는 검사유효기간(이하 "검사유효기간"이라 한다)이 끝난 후에 계속하여 운행하려는 경우에 실시하는 검사와 「대기환경보전법」 제62조 및 「소음ㆍ진동관리법」 제37조에 따른 운행차의 정기검사

② 제1항에 따른 건설기계의 검사를 받으려는 자는 국토교통부장관에게 검사신청서를 제출하고 해당 건설기계를 제시하여야 한다. <개정 2013.3.23>

③ 국토교통부장관은 제1항에 따라 건설기계 검사를 실시할 때에는 다음 각 호의 사항을 확인하여야 한다. <개정 2013.3.23>

④ 시ㆍ도지사는 제1항제1호에 따른 신규 등록검사를 받은 건설기계 중 제1항제2호에 따른 정기검사를 받아야 하는 건설기계의 경우에는 건설기계검사증을 건설기계의 소유자에게 발급하여야 한다.

⑧ 시ㆍ도지사는 건설기계 소유자가 천재지변이나 그 밖에 부득이한 사유로 다음 각 호의 어느 하나에 해당하는 검사를 받을 수 없거나 명령을 이행할 수 없다고 인정하는 경우에는 국토교통부령으로 정하는 바에 따라 그 기간을 연장할 수 있다. <개정 2013.3.23, 2022.2.3>

1. 제1항제2호부터 제4호까지의 규정에 따른 검사

⑩ 시ㆍ도지사는 건설기계의 소유자가 제5항부터 제7항까지의 규정에 따른 정기검사 명령, 수시검사 명령 또는 정비 명령에 따르지 아니하는 경우에는 해당 건설기계의 등록번호표를 영치할 수 있다. 이 경우 시ㆍ도지사는 등록번호표를 영치한 사실을 해당 건설기계의 소유자에게 통지하여야 한다. <신설 2012.2.22, 2022.2.3>
