개발이익 환수에 관한 법률 제17조(시효)

① 개발부담금을 징수할 수 있는 권리와 개발부담금의 과오납금을 환급받을 권리는 행사할 수 있는 시점부터 5년간 행사하지 아니하면 소멸시효가 완성된다.

② 제1항에 따른 개발부담금 징수권의 소멸시효는 다음 각 호의 어느 하나의 사유로 중단된다.

(2) The^ð디 extinctive엑스팅크티^v브 prescription프^r러스크^r립션 of어^v브 the^ð더 right^r라잇 to투 collect컬렉트 the^ð더 development디^v벨럽먼트 charge차지 under언더 paragraph패^r러그^r래^f프 (1) shall섈 be비 interrupted인터^r럽티드 by바이 any에니 of어^v브 the^ð더 following:^f팔로잉

③ 제2항에 따라 중단된 소멸시효는 다음 각 호의 어느 하나에 해당하는 기간이 지난 시점부터 새로 진행한다.

(3) Extinctive엑스팅크티^v브 prescription프^r러스크^r립션 interrupted인터^r럽티드 under언더 paragraph패^r러그^r래^f프 (2) shall섈 run^r런 anew어누 from^f프^r럼 the^ð더 time타임 the^ð더 period피^r리어드 falling^f팔링 under언더 any에니 of어^v브 the^ð더 following^f팔로잉 has해즈 elapsed:일랩스트

④ 제1항에 따른 개발부담금 징수권의 소멸시효는 납부의 연기 또는 분할 납부의 기간 중에는 진행하지 아니한다.

(4) The^ð디 extinctive엑스팅크티^v브 prescription프^r러스크^r립션 of어^v브 the^ð더 right^r라잇 to투 collect컬렉트 the^ð더 development디^v벨럽먼트 charge차지 under언더 paragraph패^r러그^r래^f프 (1) shall섈 not낫 run^r런 during두^r링 a어 period피^r리어드 of어^v브 deferment디^f퍼먼트 of어^v브 payment페이먼트 or오 installment인스톨먼트 payment.페이먼트

⑤ 제1항에 따른 환급청구권의 소멸시효는 환급청구권 행사로 중단된다.

⑥ 소멸시효에 관하여 이 법에 규정되어 있는 것 외에는 「민법」을 준용한다.
