가족관계의 등록 등에 관한 법률 제96조(국적취득자의 성과 본의 창설 신고)

① 외국의 성을 쓰는 국적취득자가 그 성을 쓰지 아니하고 새로이 성(姓)ㆍ본(本)을 정하고자 하는 경우에는 그 등록기준지ㆍ주소지 또는 등록기준지로 하고자 하는 곳을 관할하는 가정법원의 허가를 받고 그 등본을 받은 날부터 1개월 이내에 그 성과 본을 신고하여야 한다.

② 대한민국의 국적을 회복하거나 재취득하는 경우에는 종전에 사용하던 대한민국식 성명으로 국적회복신고 또는 국적재취득신고를 할 수 있다.

③ 제2항의 경우 신고서에는 종전에 사용하던 대한민국식 성명을 소명하여야 한다.

④ 신고서에는 다음 사항을 기재하여야 한다.

⑤ 제4항의 신고서에는 제1항에 따른 허가의 등본을 첨부하여야 한다.

⑥ 제1항의 경우에 가정법원은 심리(審理)를 위하여 국가경찰관서의 장에게 성ㆍ본 창설허가 신청인의 범죄경력 조회를 요청할 수 있고, 그 요청을 받은 국가경찰관서의 장은 지체 없이 그 결과를 회보하여야 한다. <신설 2013.7.30>
