가정폭력방지 및 피해자보호 등에 관한 법률 제5조(상담소의 설치ㆍ운영)

① 국가나 지방자치단체는 가정폭력 관련 상담소(이하 "상담소"라 한다)를 설치ㆍ운영할 수 있다.

② 국가나 지방자치단체 외의 자가 상담소를 설치ㆍ운영하려면 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장(구청장은 자치구의 구청장을 말하며, 이하 "시장ㆍ군수ㆍ구청장"이라 한다)에게 신고하여야 한다. 신고한 사항 중 성평등가족부령으로 정하는 중요 사항을 변경하려는 경우에도 또한 같다. <개정 2018.3.13, 2025.10.1>

③ 시장ㆍ군수ㆍ구청장은 제2항에 따른 신고를 받은 날부터 10일 이내(변경신고의 경우 5일 이내)에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하여야 한다. <신설 2018.3.13>

④ 상담소는 외국인, 장애인 등 대상별로 특화하여 운영할 수 있다. <신설 2017.12.12, 2018.3.13>

⑤ 상담소의 설치ㆍ운영기준, 상담소에 두는 상담원의 수와 신고절차 등에 필요한 사항은 성평등가족부령으로 정한다. <개정 2008.2.29, 2010.1.18, 2017.12.12, 2018.3.13, 2025.10.1>
