가정폭력방지 및 피해자보호 등에 관한 법률 시행령 제2조(임시 보호의 기간 등)

① 법 제5조에 따른 가정폭력 관련 상담소(이하 "상담소"라 한다)의 장은 법 제6조제2호 및 제4호에 따른 피해자를 상담한 결과 임시 보호가 필요하다고 인정하는 경우 임시보호를 받게 하여야 한다. 이 경우 해당 상담소가 임시보호시설이 갖추어지지 아니한 상담소일 때에는 지체 없이 임시보호시설을 갖춘 상담소 또는 법 제7조에 따른 가정폭력피해자 보호시설(이하 "보호시설"이라 한다)에 피해자를 인도하여 임시 보호를 받게 하여야 한다.

② 제1항에 따라 상담소 또는 보호시설의 장이 하는 임시 보호는 3일 이내여야 한다.

(2) Temporary템퍼^r레^r리 protection프^r러텍션 provided프^r러^v바이디드 by바이 the^ð더 head헤드 of어^v브 a어 counseling카운설링 center센터 or오 protection프^r러텍션 facility^f퍼실리티 under언더 paragraph패^r러그^r래^f프 (1) shall섈 be비 within위^ð딘 three^θ쓰^r리 days.데이즈

③ 제2항에도 불구하고 상담소 또는 보호시설의 장이 임시 보호 대상자를 보호하기 위하여 특히 필요하다고 인정하는 경우에는 임시 보호의 기간을 7일 이내로 할 수 있다.

④ 제1항부터 제3항까지의 규정에 따른 임시 보호를 할 때에는 피해자 본인 또는 그 보호자의 동의를 받아야 한다.

(4) When웬 providing프^r러^v바이딩 temporary템퍼^r레^r리 protection프^r러텍션 under언더 paragraphs패^r러그^r래^f프스 (1) through^θ쓰^r루 (3), the^ð더 consent컨센트 of어^v브 the^ð더 victim^v빅텀 himself힘셀^f프 or오 herself허셀^f프 or오 the^ð더 victim's^v빅텀즈 guardian가디언 shall섈 be비 obtained.어브테인드
