가맹사업거래의 공정화에 관한 법률 제15조의3(공제조합의 설립)

①가맹본부는 제15조의2제1항제3호에 따른 공제사업을 영위하기 위하여 공정거래위원회의 인가를 받아 공제조합(이하 "공제조합"이라 한다)을 설립할 수 있다.

②공제조합은 법인으로 하며, 주된 사무소의 소재지에 설립등기를 함으로써 성립한다.

(2) A어 mutual뮤추얼 aid에이드 association어소우시에이션 shall섈 be비 a어 corporation코퍼^r레이션 and앤드 is이즈 established이스태블리시트 by바이 registration^r레지스트^r레이션 of어^v브 establishment이스태블리시먼트 at앳 the^ð더 location로케이션 of어^v브 its잇츠 principal프^r린서플 office.오^f피스

③공제조합에 가입한 가맹본부는 공제사업의 수행에 필요한 출자금 등을 조합에 납부하여야 한다.

(3) A어 franchisor^f프^r랜차이저 that^ð댓 has해즈 joined조인드 a어 mutual뮤추얼 aid에이드 association어소우시에이션 shall섈 pay페이 to투 the^ð디 association어소우시에이션 the^ð디 investment,인^v베스트먼트 etc.엣세터^r러 necessary네서세^r리 for^f포 conducting컨덕팅 the^ð더 mutual뮤추얼 aid에이드 business.비즈니스

④공제조합의 기본재산은 조합원의 출자금 등으로 조성한다.

(4) The^ð더 basic베이식 assets애셋츠 of어^v브 a어 mutual뮤추얼 aid에이드 association어소우시에이션 shall섈 be비 formed^f폼드 from^f프^r럼 the^ð디 investments,인^v베스트먼츠 etc.엣세터^r러 of어^v브 its잇츠 members.멤버즈

⑤공제조합의 조합원의 자격, 임원에 관한 사항 및 출자금의 부담기준에 관한 사항은 정관으로 정한다.

(5) The^ð더 qualifications콸러^f퍼케이션즈 of어^v브 members,멤버즈 matters매터즈 concerning컨서닝 officers,오^f퍼서즈 and앤드 matters매터즈 concerning컨서닝 the^ð더 standards스탠더즈 for^f포 bearing베^r링 investments인^v베스트먼츠 of어^v브 a어 mutual뮤추얼 aid에이드 association어소우시에이션 shall섈 be비 prescribed프^r리스크^r라이브드 by바이 its잇츠 articles아터클즈 of어^v브 incorporation.인코퍼^r레이션

⑥공제조합의 설립인가 기준 및 절차, 정관기재사항, 운영 및 감독 등에 관하여 필요한 사항은 대통령령으로 정한다.

(6) The^ð더 standards스탠더즈 and앤드 procedures프^r러시저즈 for^f포 authorizing오^θ써^r라이징 establishment이스태블리시먼트 of어^v브 a어 mutual뮤추얼 aid에이드 association,어소우시에이션 matters매터즈 to투 be비 stated스테이티드 in인 the^ð디 articles아터클즈 of어^v브 incorporation,인코퍼^r레이션 operation아퍼^r레이션 and앤드 supervision,수퍼^v비전 and앤드 other어^ð더 necessary네서세^r리 matters매터즈 shall섈 be비 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree.디크^r리

⑦공제조합이 제1항에 따른 공제사업을 하고자 하는 때에는 공제규정을 정하여 공정거래위원회의 인가를 받아야 한다. 공제규정을 변경하고자 하는 때에도 또한 같다.

(7) When웬 a어 mutual뮤추얼 aid에이드 association어소우시에이션 intends인텐즈 to투 conduct칸덕트 the^ð더 mutual뮤추얼 aid에이드 business비즈니스 under언더 paragraph패^r러그^r래^f프 (1), it잇 shall섈 establish이스태블리시 mutual뮤추얼 aid에이드 rules^r룰즈 and앤드 obtain어브테인 the^ð디 authorization오^θ써^r러제이션 of어^v브 the^ð더 Fair^f페어 Trade트^r레이드 Commission.커미션 The^ð더 same세임 applies어플라이즈 when웬 it잇 intends인텐즈 to투 amend어멘드 the^ð더 mutual뮤추얼 aid에이드 rules.^r룰즈

⑧제7항의 공제규정에는 공제사업의 범위, 공제료, 공제사업에 충당하기 위한 책임준비금 등 공제사업의 운영에 관하여 필요한 사항을 포함하여야 한다.

(8) The^ð더 mutual뮤추얼 aid에이드 rules^r룰즈 under언더 paragraph패^r러그^r래^f프 (7) shall섈 include인클루드 matters매터즈 necessary네서세^r리 for^f포 the^ð디 operation아퍼^r레이션 of어^v브 the^ð더 mutual뮤추얼 aid에이드 business,비즈니스 such서치 as애즈 the^ð더 scope스코우프 of어^v브 the^ð더 mutual뮤추얼 aid에이드 business,비즈니스 mutual뮤추얼 aid에이드 premiums,프^r리미엄즈 and앤드 reserves^r리저^v브즈 to투 cover커^v버 the^ð더 mutual뮤추얼 aid에이드 business.비즈니스

⑨공제조합에 관하여 이 법에 규정된 것을 제외하고는 「민법」 중 사단법인에 관한 규정을 준용한다.

⑩이 법에 따른 공제조합의 사업에 대하여는 「보험업법」을 적용하지 아니한다.

(10) The^ð디 Insurance인슈^r런스 Business비즈니스 Act액트 does더즈 not낫 apply어플라이 to투 the^ð더 business비즈니스 of어^v브 a어 mutual뮤추얼 aid에이드 association어소우시에이션 under언더 this^ð디스 Act.액트
