Enforcement Decree of the Act on Liability for Compensation for and Relief of Environmental Pollution Damage, Article 8 (Scope of Coverage of Environmental Liability Insurance and Coverage Contracts, etc.)
① 법 제17조제1항 또는 제2항에 따라 환경책임보험에 가입하거나 보장계약을 체결하여야 하는 사업자는 법 제17조제1항 각 호의 시설이 설치된 사업장별로 가입하거나 체결하여야 한다.
(1) A business operator who must subscribe to environmental liability insurance or conclude a coverage contract under Article 17 (1) or (2) of the Act shall subscribe or conclude for each place of business where a facility in the subparagraphs of Article 17 (1) of the Act is installed.
② 법 제17조제1항 또는 제2항에 따른 환경책임보험 또는 보장계약의 보장 금액은 별표 4와 같다.
(2) The coverage amount of environmental liability insurance or a coverage contract under Article 17 (1) or (2) of the Act is as listed in Table 4.
③ 제2항에 따른 보장 금액에는 피해배상금, 오염정화비용, 긴급조치비용, 쟁송비용 및 위자료 등이 포함된 것으로 본다.
(3) The coverage amount under paragraph (2) shall be deemed to include damages, pollution cleanup costs, emergency measure costs, litigation costs, and consolation money.
④ 법 제17조제1항 또는 제2항에 따른 환경책임보험 또는 보장계약의 보장 범위에는 사업장에 설치된 시설로 인한 환경오염피해가 모두 포함되어야 한다. <개정 2024.4.16>
(4) The scope of coverage of environmental liability insurance or a coverage contract under Article 17 (1) or (2) of the Act shall include all environmental pollution damage caused by facilities installed at the place of business.
⑤ 법 제17조제4항에서 "해당 시설의 종류 및 규모, 해당 시설에서 배출되는 오염물질의 종류 및 배출량 등 대통령령으로 정하는 사항"이란 다음 각 호의 사항을 말한다. <개정 2024.4.16, 2025.10.1>
(5) In Article 17 (4) of the Act, "matters prescribed by Presidential Decree, such as the type and scale of the facility and the type and emission volume of pollutants emitted from the facility" means the following:
1. 해당 시설의 종류 및 규모
1. The type and scale of the facility;
2. 해당 시설에서 배출되는 오염물질의 종류 및 배출량
2. The type and emission volume of pollutants emitted from the facility;
3. 해당 시설에 대한 인ㆍ허가 또는 등록ㆍ신고에 관한 사항(변경 인ㆍ허가 또는 변경 등록ㆍ신고 사항을 포함한다)
3. Matters concerning permission, authorization, registration, or reporting of the facility (including changes to permission, authorization, registration, or reporting);
4. 그 밖에 환경책임보험에의 가입 또는 보장계약의 체결에 필요하다고 기후에너지환경부장관이 정하여 고시하는 사항
4. Other matters that the Minister of Climate, Energy and Environment determines and publicly notifies as necessary for subscribing to environmental liability insurance or concluding a coverage contract.
