Enforcement Decree of the Act on the Prohibition of Chemical Weapons and Biological Weapons and the Regulation of Manufacture and Import/Export of Specified Chemicals and Biological Agents, Article 11 (Scope of Special Provisions for National Research Facilities)
① 법 제19조에 따라 제조허가를 받지 아니하거나 제조신고를 하지 아니하고 국립 연구시설에서 제조할 수 있는 1종화학물질 및 생물작용제등의 수량은 다음 각 호의 구분에 따른다.
(1) The quantities of Class 1 chemicals and biological agents, etc. that may be manufactured in national research facilities without obtaining manufacturing permission or filing a manufacturing report pursuant to Article 19 of the Act are as follows:
1. 국방과학연구소
1. The Agency for Defense Development:
가. 1종화학물질: 연간 1톤 이하
(a) Class 1 chemicals: One ton or less per year; and
나. 생물작용제등: 연간 1천밀리그램 이하
(b) Biological agents, etc.: 1,000 milligrams or less per year; and
2. 그 밖의 국립 연구시설
2. Other national research facilities:
가. 1종화학물질: 연간 10킬로그램 이하
(a) Class 1 chemicals: 10 kilograms or less per year; and
나. 생물작용제등: 연간 1천밀리그램 이하
(b) Biological agents, etc.: 1,000 milligrams or less per year.
② 법 제19조에 따라 국립 연구시설에서 1종화학물질이나 생물작용제등을 제조하려는 자는 그 제조에 대하여 미리 해당 국립 연구시설을 관장하는 중앙행정기관의 장의 인정을 받아야 한다.
(2) A person who intends to manufacture Class 1 chemicals or biological agents, etc. in a national research facility pursuant to Article 19 of the Act shall obtain in advance the recognition of the head of the central administrative agency having jurisdiction over that national research facility for the manufacture.
