형법 제98조(적국을 위한 간첩)

① 적국을 위하여 적국의 지령, 사주, 그 밖의 의사 연락 하에 국가기밀을 탐지ㆍ수집ㆍ누설ㆍ전달ㆍ중개하거나 이를 방조한 자는 사형, 무기 또는 7년 이상의 징역에 처한다. <개정 2026.3.12>
