해양생태계의 보전 및 관리에 관한 법률 시행령 제35조의2(업무의 위탁)
Enforcement Decree of the Act on the Conservation and Management of Marine Ecosystems, Article 35-2 (Entrustment of Duties)
① 해양수산부장관은 법 제60조제3항에 따라 다음 각 호의 업무를 제3항에 따라 지정하는 기관에 위탁한다. <개정 2017.12.29, 2019.6.11, 2021.5.25>
(1) Pursuant to Article 60 (3) of the Act, the Minister of Oceans and Fisheries entrusts the following duties to the institution designated under paragraph (3):
1. 국가해양생태계종합조사
1. The national comprehensive marine ecosystem survey;
2. 법 제11조제1항 및 제2항에 따른 정밀조사 및 보완조사
2. Detailed surveys and supplementary surveys under Article 11 (1) and (2) of the Act;
3. 법 제17조제2항에 따른 서식지외보전기관의 비용 지원
3. Support of expenses of ex-situ conservation institutions under Article 17 (2) of the Act;
4. 법 제18조제3항에 따른 해양동물전문구조ㆍ치료기관의 비용 지원
4. Support of expenses of specialized marine animal rescue and treatment institutions under Article 18 (3) of the Act;
5. 법 제19조제1항에 따른 해양보호생물에 대한 보전대책의 실시
5. Implementation of conservation measures for marine protected species under Article 19 (1) of the Act;
6. 법 제23조제3항에 따른 해양생태계교란생물의 관리 중 해양생태계교란생물의 조사 및 제거
6. Survey and removal of marine ecosystem disturbing organisms among the management of marine ecosystem disturbing organisms under Article 23 (3) of the Act;
7. 법 제24조에 따른 유해해양생물의 관리 중 유해해양생물의 조사 및 제거
7. Survey and removal of harmful marine organisms among the management of harmful marine organisms under Article 24 of the Act;
8. 법 제25조에 따른 해양보호구역의 관리
8. Management of marine protected areas under Article 25 of the Act;
9. 법 제29조제1항 및 제4항에 따른 해양보호구역의 조사 및 관찰
9. Survey and observation of marine protected areas under Article 29 (1) and (4) of the Act;
10. 법 제43조에 따른 해양생태계보전ㆍ이용시설의 설치ㆍ운영
10. Installation and operation of marine ecosystem conservation and use facilities under Article 43 of the Act.
② 시ㆍ도지사는 법 제60조제3항에 따라 다음 각 호의 업무를 제3항에 따라 지정하는 기관에 위탁한다. <신설 2017.12.29, 2018.5.28, 2021.5.25>
(2) Pursuant to Article 60 (3) of the Act, a Mayor/Do Governor entrusts the following duties to the institution designated under paragraph (3):
1. 법 제23조제3항 전단에 따른 해양생태계교란생물 관련 조치 중 해양생태계교란생물의 포획ㆍ채취
1. Capture and collection of marine ecosystem disturbing organisms among measures relating to marine ecosystem disturbing organisms under the first sentence of Article 23 (3) of the Act;
2. 법 제24조에 따른 유해해양생물의 관리 중 유해해양생물의 포획ㆍ채취
2. Capture and collection of harmful marine organisms among the management of harmful marine organisms under Article 24 of the Act;
3. 법 제36조제5항에 따라 준용되는 법 제29조제1항 및 제4항에 따른 시ㆍ도해양보호구역에 대한 조사ㆍ측량 및 관찰
3. Survey, measurement, and observation of Si/Do marine protected areas under Article 29 (1) and (4) of the Act as applied mutatis mutandis by Article 36 (5) of the Act;
3의2. 법 제36조제5항에 따라 준용되는 법 제34조에 따른 시ㆍ도해양보호구역 및 그 인접지역에 대한 사업
3-2. Projects for Si/Do marine protected areas and their adjacent areas under Article 34 of the Act as applied mutatis mutandis by Article 36 (5) of the Act;
4. 법 제43조에 따른 해양생태계보전ㆍ이용시설의 설치ㆍ운영
4. Installation and operation of marine ecosystem conservation and use facilities under Article 43 of the Act;
5. 법 제46조제3항에 따른 해양생태계 복원대책의 수립ㆍ시행
5. Formulation and implementation of marine ecosystem restoration measures under Article 46 (3) of the Act.
③ 제1항 또는 제2항에 따라 업무를 위탁받는 기관은 그 위탁받을 업무의 구분에 따라 해양수산부장관 또는 시ㆍ도지사가 지정하는 다음 각 호의 기관으로 한다. <개정 2017.12.29, 2018.4.30>
(3) The institutions entrusted with duties under paragraph (1) or (2) shall be the following institutions designated by the Minister of Oceans and Fisheries or the Mayor/Do Governor according to the classification of the duties to be entrusted:
1. 「해양환경관리법」 제96조제1항에 따른 해양환경공단
1. The Korea Marine Environment Management Corporation under Article 96 (1) of the Marine Environment Management Act;
2. 「국립해양생물자원관의 설립 및 운영에 관한 법률」에 따른 국립해양생물자원관
2. The National Marine Biodiversity Institute of Korea under the Act on the Establishment and Operation of the National Marine Biodiversity Institute of Korea.
④ 해양수산부장관 또는 시ㆍ도지사는 제3항에 따라 수탁기관을 지정하는 경우에는 위탁할 업무의 내용 및 처리방법, 그 밖에 필요한 사항을 정하여 관보 또는 공보에 고시하여야 한다. <개정 2017.12.29>
(4) When designating an entrusted institution under paragraph (3), the Minister of Oceans and Fisheries or the Mayor/Do Governor shall prescribe the content and handling method of the duties to be entrusted and other necessary matters and publicly notify them in the Official Gazette or an official gazette.
