한부모가족지원법 제21조(폐지 또는 휴지)

① 제20조제3항에 따라 한부모가족복지시설의 설치 신고를 한 자가 그 시설의 폐지, 일시적 운영중단 또는 운영재개를 하려면 여성가족부령으로 정하는 바에 따라 미리 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 신고하여야 한다. <개정 2008.2.29, 2010.1.18, 2010.5.17, 2011.4.12, 2014.1.21, 2016.3.2, 2020.10.20>

② 한부모가족복지시설의 장은 한부모가족복지시설을 폐지하거나 그 시설의 운영을 일시적으로 중단하는 경우에는 여성가족부령으로 정하는 바에 따라 그 시설에 입소하고 있는 사람이 다른 한부모가족복지시설로 옮길 수 있도록 하는 등 입소자의 권익을 보호하기 위한 조치를 하여야 한다. <신설 2016.3.2>

③ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따른 신고를 받은 경우 그 신고받은 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다. 이 경우 시설의 폐지 또는 일시적 운영중단 신고를 받은 경우에는 한부모가족복지시설의 장이 제2항에 따른 입소자의 권익을 보호하기 위한 조치를 하였는지 여부를 확인하는 등 여성가족부령으로 정하는 조치를 한 후 수리하여야 한다. <신설 2016.3.2, 2020.10.20>
