학교시설사업 촉진법 시행령 제18조(준공검사등)

①사업시행자 및 학교시설의 건축등을 하는 자(국가 또는 지방자치단체인 사업시행자 및 건축등을 하는 자를 제외한다. 이하 이 조에서 같다)는 학교시설사업(학교시설의 건축등을 포함한다. 이하 이 조에서 같다)을 완료한 때에는 완료한 날부터 7일이내에 감독청에 학교시설사업의 완료에 관한 신고를 하여야 한다.

②감독청이 제1항에 따른 학교시설사업의 완료에 관한 신고를 받은 때에는 신고받은 날부터 14일이내에 준공검사(건축등의 경우에는 사용승인검사를 말한다. 이하 이 조에서 같다)를 실시하여야 하며, 준공검사에 합격된 경우에는 그 사업시행자 및 건축등을 하는 자에게 교육부령이 정하는 준공검사증명서(건축등의 경우에는 사용승인서를 말한다. 이하 이 조에서 같다)를 발급하여야 한다. 이 경우 감독청은 「소방시설 설치 및 관리에 관한 법률」 제6조제4항에 따른 소방시설공사의 완공검사필증의 발급을 미리 확인하여야 한다. <개정 2000.10.18, 2001.1.29, 2008.2.29, 2008.10.24, 2013.3.23, 2017.1.26, 2022.11.29>

③감독청은 제2항에 따라 준공검사증명서를 발급한 때에는 법 제5조 각 호의 해당 사항의 소관 행정기관의 장에게는 준공검사 합격의 사실을 통보하고, 해당 시장ㆍ군수 또는 구청장에게는 다음 각 호의 서류를 첨부하여 이에 관한 사항을 통보하여야 한다. <개정 2008.10.24>
