폐기물관리법 제5조의2(생활폐기물의 발생지 처리)

① 특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장은 관할 구역에서 발생한 생활폐기물을 관할 구역 내 폐기물처리시설 또는 관할 구역을 대상 지역으로 하는 제5조의 광역 폐기물처리시설에서 처리하도록 필요한 조치를 하여야 한다.

② 특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장은 제1항의 조치에도 불구하고 관할 구역에서 발생한 생활폐기물을 모두 처리할 수 없을 때에는 관할 구역 외의 특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장과 협의하여 해당 지방자치단체의 관할 구역으로 생활폐기물을 반출하여 처리할 수 있다.
