특허법 제78조(심사 또는 소송절차의 중지)

① 특허출원의 심사에 필요한 경우에는 특허취소신청에 대한 결정이나 심결이 확정될 때까지 또는 소송절차가 완결될 때까지 그 심사절차를 중지할 수 있다. <개정 2016.2.29>

② 법원은 소송에 필요한 경우에는 특허출원에 대한 특허여부결정이 확정될 때까지 그 소송절차를 중지할 수 있다.

③ 제1항 및 제2항에 따른 중지에 대해서는 불복할 수 없다.
