Act on the Aggravated Punishment, etc. of Specific Crimes, Article 5-13 (Aggravated Punishment of Causing Death or Injury to Children in Children's Protection Zones)

자동차등의 운전자가 「도로교통법」 제12조제3항에 따른 어린이 보호구역에서 같은 조 제1항에 따른 조치를 준수하고 어린이의 안전에 유의하면서 운전하여야 할 의무를 위반하여 어린이(13세 미만인 사람을 말한다. 이하 같다)에게 「교통사고처리 특례법」 제3조제1항의 죄를 범한 경우에는 다음 각 호의 구분에 따라 가중처벌한다. <개정 2022.12.27>

1. 어린이를 사망에 이르게 한 경우에는 무기 또는 3년 이상의 징역에 처한다.
