치료감호 등에 관한 법률 제46조(치료감호의 시효)

① 피치료감호자는 그 판결이 확정된 후 집행을 받지 아니하고 다음 각 호의 구분에 따른 기간이 지나면 시효가 완성되어 집행이 면제된다.

② 시효는 치료감호의 집행정지 기간 또는 가종료 기간이나 그 밖에 집행할 수 없는 기간에는 진행되지 아니한다.

③ 시효는 피치료감호자를 체포함으로써 중단된다.
