치료감호 등에 관한 법률 제45조(치료감호 청구의 시효)

① 치료감호 청구의 시효는 치료감호가 청구된 사건과 동시에 심리하거나 심리할 수 있었던 죄에 대한 공소시효기간이 지나면 완성된다.

② 치료감호가 청구된 사건은 판결의 확정 없이 치료감호가 청구되었을 때부터 15년이 지나면 청구의 시효가 완성된 것으로 본다.
