출입국관리법 제76조의5(난민여행증명서)

① 법무부장관은 「난민법」에 따른 난민인정자가 출국하려고 할 때에는 그의 신청에 의하여 대통령령으로 정하는 바에 따라 난민여행증명서를 발급하여야 한다. 다만, 그의 출국이 대한민국의 안전을 해칠 우려가 있다고 인정될 때에는 그러하지 아니하다. <개정 2012.2.10>

② 제1항에 따른 난민여행증명서의 유효기간은 3년으로 한다. <개정 2016.3.29>

③ 제1항에 따라 난민여행증명서를 발급받은 사람은 그 증명서의 유효기간 만료일까지 횟수에 제한 없이 대한민국에서 출국하거나 대한민국으로 입국할 수 있다. 이 경우 입국할 때에는 제30조에 따른 재입국허가를 받지 아니하여도 된다. <개정 2016.3.29>

④ 법무부장관은 제3항의 경우 특히 필요하다고 인정되면 3개월 이상 1년 미만의 범위에서 입국할 수 있는 기간을 제한할 수 있다.

⑤ 법무부장관은 제1항에 따라 난민여행증명서를 발급받고 출국한 사람이 질병이나 그 밖의 부득이한 사유로 그 증명서의 유효기간 내에 재입국할 수 없는 경우에는 그의 신청을 받아 6개월을 초과하지 아니하는 범위에서 그 유효기간의 연장을 허가할 수 있다.

⑥ 법무부장관은 제5항에 따른 유효기간 연장허가에 관한 권한을 대통령령으로 정하는 바에 따라 재외공관의 장에게 위임할 수 있다.
