Enforcement Decree of the Act on the Safety Control of Firearms, Swords and Knives, Explosives, etc., Article 26 (Conduct of Education)

①법 제22조제1항 단서에 따라 교육을 면제하거나 허가를 받은 후에 교육을 받을 수 있는 사람은 다음 각 호와 같다. <개정 1990.3.31, 1996.6.20, 2001.3.31, 2006.6.29, 2008.1.22, 2008.2.29, 2013.3.23, 2014.11.19, 2016.1.6, 2017.7.26>

1. 교육면제대상자

1. Persons퍼슨즈 exempted이그젬프티드 from^f프^r럼 education:에저케이션

가. 총포ㆍ석궁의 제조업자ㆍ판매업자 및 임대업자

(a)어 Manufacturers,매뉴^f팩처^r러즈 sellers,셀러즈 and앤드 lessors레서즈 of어^v브 firearms^f파이어^r람즈 and앤드 crossbows;크^r로스보우즈

나. 총포ㆍ석궁 또는 화약류의 취급업소에서 6월이상 총포ㆍ석궁 또는 화약류 취급업무에 종사한 경험이 있는 사람

(b)비 A어 person퍼슨 who후 has해즈 at앳 least리스트 six식스 months먼^θ쓰 of어^v브 experience익스피^r리언스 engaged엔게이지드 in인 handling핸들링 firearms,^f파이어^r람즈 crossbows,크^r로스보우즈 or오 explosives익스플로우시^v브즈 at앳 a어 business비즈니스 handling핸들링 firearms,^f파이어^r람즈 crossbows,크^r로스보우즈 or오 explosives;익스플로우시^v브즈

다. 대한체육회에 가맹된 사격경기단체에 선수로 등록된 사람

라. 국가경찰의 교육기관ㆍ총기전담 취급부서, 군의 병기학교, 군사격지도대, 대한체육회 또는 대한체육회산하 경기단체에서 6월이상 총기취급에 종사한 경험이 있는 사람

바. 행정안전부령으로 정하는 교육면제 평가시험에 합격한 사람

(f)에^f프 A어 person퍼슨 who후 has해즈 passed패스트 an앤 education에저케이션 exemption이그젬프션 evaluation이^v밸류에이션 examination이그재머네이션 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Ministry미너스트^r리 of어^v브 the^ð디 Interior인티^r리어 and앤드 Safety;세이^f프티

2. 사후 교육대상자

2. Persons퍼슨즈 subject서브젝트 to투 post-hoc포우스트-학 education:에저케이션

가. 총포ㆍ석궁 소지허가신청후 사격 및 수렵대회요원으로 참가하게 된 사람

(a)어 A어 person퍼슨 who,후 after애^f프터 applying어플라이잉 for^f포 a어 permit퍼밋 to투 possess퍼제스 firearms^f파이어^r람즈 or오 crossbows,크^r로스보우즈 comes컴즈 to투 participate파티서페잇 as애즈 a어 staff스태^f프 member멤버 of어^v브 a어 shooting슈팅 or오 hunting헌팅 competition;캄퍼티션

나. 총포ㆍ석궁 소지허가신청후 질병 그 밖의 부득이한 사유가 발생한 사람

(b)비 A어 person퍼슨 who,후 after애^f프터 applying어플라이잉 for^f포 a어 permit퍼밋 to투 possess퍼제스 firearms^f파이어^r람즈 or오 crossbows,크^r로스보우즈 has해즈 been빈 affected어^f펙티드 by바이 illness일니스 or오 other어^ð더 unavoidable어너^v보이더블 reasons.^r리즌즈

②제1항제2호의 규정에 의하여 사후교육을 받을 사람은 특별한 사정이 없는 한 제2호의 사유가 소멸된 날로부터 7일이내에 교육을 받아야 한다.

(2) A어 person퍼슨 who후 is이즈 to투 receive^r러시^v브 post-hoc포우스트-학 education에저케이션 under언더 paragraph패^r러그^r래^f프 (1) 2 shall섈 receive^r러시^v브 education에저케이션 within위^ð딘 seven세^v븐 days데이즈 from^f프^r럼 the^ð더 date데잇 the^ð더 reason^r리즌 in인 subparagraph서브패^r러그^r래^f프 2 ceases시시즈 to투 exist,이그지스트 unless언레스 there^ð데어 are아 special스페실 circumstances.서컴스탠시즈

③시ㆍ도경찰청장은 다음 각 호의 어느 하나에 해당하는 사람에 대하여 재해의 예방 또는 공공의 안전을 위하여 행정안전부령이 정하는 바에 따라 총포ㆍ화약류ㆍ분사기ㆍ전자충격기ㆍ석궁에 관한 안전교육을 실시할 수 있다. 다만, 제2호 중 공기총ㆍ석궁 사격장 설치자 및 공기총ㆍ분사기ㆍ전자충격기ㆍ석궁 소지허가를 받은 사람과 제4호 중 3급저장소 및 간이저장소 설치자에 대하여는 경찰서장이 총포ㆍ화약류ㆍ분사기ㆍ전자충격기ㆍ석궁에 관한 안전교육을 실시할 수 있다. <개정 1987.11.10, 1990.3.31, 1991.7.30, 1996.6.20, 1999.6.30, 2006.3.10, 2008.2.29, 2012.1.31, 2013.3.23, 2014.11.19, 2016.1.6, 2017.7.26, 2020.12.31>
