첨단재생의료 및 첨단바이오의약품 안전 및 지원에 관한 법률 제40조(회수ㆍ폐기 명령 등)

① 보건복지부장관은 국민보건에 위해를 주었거나 줄 염려가 있는 인체세포등(이하 "위해인체세포등"이라 한다)을 첨단재생의료 실시에 사용한 재생의료기관에 그 위해인체세포등의 사용을 중지하는 등의 필요한 조치를 명할 수 있으며, 위해인체세포등으로 인하여 공중위생상 위해가 발생하였거나 발생할 우려가 있다고 인정하면 재생의료기관에 관리 중인 위해인체세포등을 회수ㆍ폐기하게 하거나 그 밖의 필요한 조치를 명할 수 있다. <개정 2024.2.20>

② 식품의약품안전처장은 위해인체세포등을 보관ㆍ처리ㆍ공급하는 세포처리시설의 장 또는 인체세포등 관리업자에게 그 위해인체세포등의 사용을 중지하는 등의 필요한 조치를 명할 수 있으며, 위해인체세포등으로 인하여 공중위생상 위해가 발생하였거나 발생할 우려가 있다고 인정하면 세포처리시설의 장 또는 인체세포등 관리업자에게 관리 중인 위해인체세포등을 회수ㆍ폐기하게 하거나 그 밖의 필요한 조치를 명할 수 있다.

③ 보건복지부장관 또는 식품의약품안전처장은 제1항 또는 제2항에 따른 명령을 받은 자가 그 명령을 이행하지 아니하거나 공중위생을 위하여 긴급한 때에는 관계 공무원에게 해당 위해인체세포등을 폐기하게 하거나 그 밖의 필요한 처분을 하게 할 수 있다.

④ 제1항부터 제3항까지의 규정에 따른 회수ㆍ폐기와 관련된 사항 중 재생의료기관에 대한 회수ㆍ폐기와 그 밖의 조치 등에 필요한 사항은 보건복지부령으로, 세포처리시설의 장 및 인체세포등 관리업자에 대한 회수ㆍ폐기와 그 밖의 조치 등에 필요한 사항은 총리령으로 정한다.
