철도의 건설 및 철도시설 유지관리에 관한 법률 제17조(시설의 귀속 등)

① 철도건설사업으로 조성 또는 설치된 토지 및 시설은 준공과 동시에 국가에 귀속된다. 다만, 대통령령으로 정하는 토지 및 시설의 경우에는 그러하지 아니하다.

② 국토교통부장관은 제1항에 따라 국가에 귀속된 고속철도시설의 사업시행자에게는 그가 투자한 총사업비의 범위에서 대통령령으로 정하는 바에 따라 그 시설을 무상으로 사용ㆍ수익하게 할 수 있다. <개정 2013.3.23>

③ 고속철도건설사업으로 조성 또는 설치되는 토지 및 시설의 귀속에 관하여는 사업시행자가 국가철도공단인 경우에는 「국가철도공단법」에서 정하는 바에 따르고, 사업시행자가 「사회기반시설에 대한 민간투자법」에 따른 민자유치 사업의 시행자인 경우에는 「사회기반시설에 대한 민간투자법」에서 정하는 바에 따른다. <개정 2020.6.9>

④ 제2항에 따른 총사업비의 산정 방법 및 무상으로 사용ㆍ수익할 수 있는 기간은 대통령령으로 정한다.
