철도의 건설 및 철도시설 유지관리에 관한 법률 제12조의2(토지의 지하부분 사용에 대한 보상)

① 사업시행자는 철도를 건설하기 위하여 다른 자의 토지의 지하부분을 사용하려는 경우에는 그 토지의 이용 가치, 지하의 깊이 및 토지 이용을 방해하는 정도 등을 고려하여 보상한다.

② 제1항에 따른 지하부분 사용에 대한 보상대상, 보상기준 및 보상방법 등에 관하여 필요한 사항은 대통령령으로 정한다.
