채무자 회생 및 파산에 관한 법률 제282조(회생계획의 변경)

①회생계획인가의 결정이 있은 후 부득이한 사유로 회생계획에 정한 사항을 변경할 필요가 생긴 때에는 회생절차가 종결되기 전에 한하여 법원은 관리인, 채무자 또는 목록에 기재되어 있거나 신고한 회생채권자ㆍ회생담보권자ㆍ주주ㆍ지분권자의 신청에 의하여 회생계획을 변경할 수 있다.

②제1항의 규정에 의하여 회생채권자ㆍ회생담보권자ㆍ주주ㆍ지분권자에게 불리한 영향을 미칠 것으로 인정되는 회생계획의 변경신청이 있는 때에는 회생계획안의 제출이 있는 경우의 절차에 관한 규정을 준용한다. 다만, 이 경우에는 회생계획의 변경으로 인하여 불리한 영향을 받지 아니하는 권리자를 절차에 참가시키지 아니할 수 있다.

③제246조 및 제247조의 규정은 회생계획변경의 결정이 있은 경우에 관하여 준용한다.
