지방자치단체 출자ㆍ출연 기관의 운영에 관한 법률 제17조(회계처리의 원칙 등)

① 출자ㆍ출연 기관은 경영 성과 및 재무 상태를 명확히 하기 위하여 회계거래를 발생 사실에 따라 처리한다.

② 출자ㆍ출연 기관은 사업 분야별로 구분하여 회계처리할 수 있다.

③ 출자ㆍ출연 기관이 계약을 체결하려는 경우에는 일반경쟁의 방식으로 하는 것을 원칙으로 한다. 다만, 계약의 목적ㆍ성질 및 규모 등을 고려하여 참가자의 자격을 제한하거나 참가자를 지명하여 경쟁에 부치거나 수의계약으로 할 수 있다.

④ 출자ㆍ출연 기관은 공정한 경쟁이나 계약의 적정한 이행을 해칠 것이 명백하다고 판단되는 자에 대해서는 2년의 범위에서 입찰참가자격을 제한할 수 있다. 이 경우 해당 출자ㆍ출연 기관의 장은 불가피한 사유가 있는 것으로 인정되는 경우를 제외하고는 「지방자치단체를 당사자로 하는 계약에 관한 법률」 제32조에 따른 계약심의위원회에서 그 입찰참가자격 제한 여부에 관하여 심의할 수 있도록 지방자치단체의 장에게 요청하여야 한다.

⑤ 출자ㆍ출연 기관은 제4항에 따라 입찰참가자격을 제한받은 자와 수의계약을 체결해서는 아니 된다. 다만, 제4항에 따라 입찰참가자격을 제한받은 자 외에는 적합한 시공자ㆍ제조자가 존재하지 아니하는 등 부득이한 사유가 있는 경우에는 그러하지 아니하다.

⑥ 제1항부터 제5항까지의 규정에 따른 회계처리, 계약의 기준 및 절차와 입찰참가자격의 제한 등에 관하여 그 밖에 필요한 사항은 대통령령으로 정한다.
