지방세법 시행령 제128조(자동차등록번호판의 영치 등)

① 특별시장ㆍ광역시장 또는 도지사는 법 제131조제1항 본문에 따라 시장ㆍ군수ㆍ구청장(특별자치시장 및 특별자치도지사는 제외한다. 이하 이 항에서 같다)의 요청을 받았을 때에는 자동차등록증을 발급하지 아니하거나 자동차등록번호판을 영치하며, 그 결과를 시장ㆍ군수ㆍ구청장에게 통보하여야 한다. <개정 2016.12.30, 2019.2.8>

② 시장ㆍ군수ㆍ구청장은 납세의무자가 독촉기간 내에 체납된 자동차세를 납부하지 아니하는 경우에는 그 자동차등록증을 발급하지 아니하거나 자동차등록번호판을 영치하여야 한다. <개정 2016.12.30, 2019.2.8>

③ 제2항에 따라 자동차등록증을 발급하지 아니하거나 자동차등록번호판을 영치하였을 때에는 납세의무자에게 그 사실을 통지하여야 한다. <개정 2019.2.8>

④ 납세의무자가 체납된 자동차세를 납부한 경우에는 시장ㆍ군수ㆍ구청장은 영치한 자동차등록번호판을 즉시 내주거나 특별시장ㆍ광역시장 또는 도지사에게 영치한 자동차등록번호판을 즉시 내주도록 요청(특별자치시장 및 특별자치도지사는 제외한다)하여야 한다. <개정 2016.12.30, 2019.2.8>
