전남광주통합특별시 설치를 위한 특별법 제67조(영재학교의 지정ㆍ설립과 운영에 관한 특례)

① 통합특별시교육감은 「영재교육 진흥법」 제6조에도 불구하고 미리 교육부장관의 동의를 받아 영재학교를 지정 또는 설립하여 운영할 수 있다. 이 경우 교육부장관은 같은 법 제4조에 따른 중앙영재교육진흥위원회의 심의를 거쳐 지정 또는 설립 동의 여부를 결정하여야 한다.

② 통합특별시교육감은 제1항에 따른 영재학교가 법령 또는 학칙을 위반하거나 그 설립목적을 달성할 수 없다고 인정되는 경우에는 미리 교육부장관의 동의를 받아 영재학교의 지정을 취소할 수 있다. 이 경우 교육부장관은 「영재교육 진흥법」 제4조에 따른 중앙영재교육진흥위원회의 심의를 거쳐 지정취소 동의 여부를 결정하여야 한다.

③ 영재학교에 대해서는 「초ㆍ중등교육법」 제9조, 제19조, 제19조의2, 제24조, 제26조, 제29조, 제31조 및 제46조를 적용하지 아니할 수 있다. 다만, 그 범위와 한계는 통합특별시조례로 정한다.

④ 영재학교의 장은 「초ㆍ중등교육법」 제47조에도 불구하고 영재교육을 받을 능력이 있다고 인정되는 외국인에게 입학(재입학ㆍ전학ㆍ편입학을 포함한다)을 허용할 수 있다.

⑤ 영재학교에는 외국어 교육을 위하여 필요한 경우 「초ㆍ중등교육법」 제21조, 「교육공무원법」 제6조 및 제32조제1항, 「사립학교법」 제52조, 제54조의4제1항ㆍ제3항에도 불구하고 대통령령으로 정하는 자격요건을 갖춘 외국인을 기간제교원 또는 강사로 임용할 수 있다.

⑥ 「영재교육 진흥법」 제5조제3항에서 대통령령으로 정하도록 한 사항은 통합특별시조례로 정한다.

⑦ 영재학교의 교육과정은 학생의 능력과 소질에 맞는 개별화된 교육을 중심으로 편성ㆍ운영하되, 구체적인 내용은 학교장이 통합특별시교육감의 승인을 받아 정한다.

⑧ 통합특별시교육감은 영재학교의 운영 성과를 정기적으로 평가하고, 그 결과를 공개하여야 한다. 평가 방법 등에 관한 구체적인 사항은 대통령령으로 정한다.

⑨ 영재학교의 학생은 그 능력과 소질에 따라 조기진급 또는 조기졸업을 할 수 있으며, 상급학교 조기입학 자격을 얻을 수 있다. 조기진급, 조기졸업 및 상급학교 조기입학에 관한 구체적인 사항은 통합특별시조례로 정한다.

⑩ 통합특별시교육감은 영재학교의 설립ㆍ운영이 특정 계층을 위한 특권교육이나 과도한 수월성 교육으로 변질되지 아니하도록 하고, 지역ㆍ계층 간 교육격차를 심화시키지 아니하도록 필요한 관리ㆍ감독 조치를 하여야 한다.
